The case “MV Trans Summer” Represented by Wu Kai Collected in to the 2014-2018 Compilation of Guangdong Foreign-related Legal Service Typical Cases

Disputes over Contract of Carriage of Goods by Sea and Vessel-induced Oil Pollution Damage Caused by MV Trans Summer by Mr. Wu Kai was collected into the 2014-2018 Compilation of Guangdong Foreign-related Legal Service Typical Cases, after being awarded as excellent case in the typical foreign-related legal service case selection project by Guangdong Lawyers Association.


On August 14, 2013, MV "Trans Summer", carrying more than 50,000 tons of laterite nickel ore, sank with hundreds of tons of fuel oil onboard in the waters in the vicinity of the Wanshan Islands in the Pearl River Estuary. Haizhu MSA arranged for cleanup and pollution prevention and claimed for the cleanup cost in an amount of 32 million yuan against the shipowner of Trans Summer. The consignee claimed for the cargo lost in an amount of 17 million yuan against the captain of the ship. The Guangdong Ocean and Fisheries Bureau claimed for the fishery resource loss in an amount of 55 million yuan. 282 fishermen, aquaculture enterprises, and beach operators claimed a total of about 45 million yuan in fishing loss, breeding loss, and beach profit loss. The total subject matter of this case is about 150 million yuan.
